Terms of Service
1. Agreement
These Terms of Service (“Terms”) are a binding agreement between you and CG Systems (“MilsimManager”, “we”, “us”) governing your access to and use of the MilsimManager Discord bot, website, and related services (the “Service”). By adding the bot to a server, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who may use the Service
You must be at least 13 years old (or the minimum age required to use Discord in your country, if higher). If you set up the Service for a community, you represent that you have authority to act for that community and to bind it to these Terms, and that you are permitted to manage that Discord server.
3. The Service
MilsimManager provides roster, rank, billet, and operations tooling for communities through a Discord bot and a web dashboard. Features may change, improve, or be discontinued over time. The Service is provided on an evolving basis and may contain new or experimental functionality.
4. Your account & responsibilities
You access the Service using your Discord account; you are responsible for activity under it and for the bot permissions you grant in your server. You agree to use the Service only for lawful purposes and in compliance with Discord’s Terms of Service and Community Guidelines.
You agree not to: use the Service to violate any law or third-party rights; attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service; resell or sublicense the Service without our permission; or use it to store unlawful content.
5. Your data & your members
If you operate the Service for a community, the member data you choose to track is your responsibility. You represent that you have the necessary rights and authority to process your members’ data through the Service, and that you will give your members any notices and obtain any consents required by applicable law. As described in our Privacy Policy, you are the controller of that data and we are your processor.
6. Trials, fees & billing
New servers may receive a free trial period. After the trial, continued access to paid functionality may require a paid subscription. When paid plans are available, fees, billing cycle, applicable taxes, renewal, and cancellation terms will be presented at the point of purchase and are incorporated into these Terms. Unless stated otherwise or required by law, fees are non-refundable. You can stop using the Service at any time by removing the bot from your server; an operator may suspend access where a trial or subscription has lapsed.
7. Suspension & termination
We may suspend or terminate access to the Service if you breach these Terms, if required for security or legal reasons, or if a trial or subscription lapses. You may stop using the Service at any time by removing the bot. On termination, the relevant community data is deleted as described in the Privacy Policy.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA WILL NOT BE LOST.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MILSIMMANAGER AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR US$50.
10. Indemnification
You agree to indemnify and hold harmless MilsimManager and its operator from claims arising out of your use of the Service, your data, or your breach of these Terms or of applicable law, including claims by your community’s members.
11. Third-party services
The Service relies on Discord and other third-party providers and is subject to their terms and availability. MilsimManager is an independent product and is not affiliated with, endorsed by, or sponsored by Discord Inc.
12. Changes to these Terms
We may update these Terms as the Service evolves. We will revise the effective date and, for material changes, provide reasonable notice. Continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. The courts located there will have exclusive jurisdiction over disputes, except where applicable law gives you the right to bring a claim elsewhere.
